REQUEST: One-Year Time Extension request (First Extension) for approved Architectural & Site Plan Review (DAP-001-758) to allow a multi-family residential project consisting of 37 condominium units on a 2.30 acre site and 43 condominium units on a 2.66 acre site. Project total is 4.96 acres and is located within the R-3/R-4 (High Density Residential) Zone.

ENVIRONMENTAL DETERMINATION: The proposed project has determined that there is no possibility that the time extension request may have a significant adverse effect on the environment. Therefore, the proposed use is exempt under Article 19, Section 15061 b. (3) of the environment. Therefore, the proposed use is exempt under Article 19, Section 15061 b. (3) of the California Environmental Quality Act (CEQA) Guidelines.

STAFF RECOMMENDATION: Staff recommends the Planning Commission approve Extension of Time for DAP-001-758, which will set a new expiration date of the Architectural and Site plan Review to October 11, 2024. Approved Planning Commission Resolutions shall remain in effect with this one-year time extension.

 

G. 2021-2029 Housing Element Update – Community Meeting Presentation.

The City of Colton’s (City) housing element was adopted January 4, 2022 and submitted to the California Department of Housing and Community Development (HCD) for review on January 19, 2022. HCD responded with comments on March 18, 2022. City staff made the revisions requested by HCD and submitted the revised Housing Element for a second time on March 8, 2023. HCD responded again on May 5, 2023 with additional comments and requested further revisions. Pursuant to Government Code section 65585, subdivision (h), HCD reported the results of its review as described in the May 5, 2023, letter.

As a result, the element has been revised further to comply with the statutory requirements of State Housing Element Law. Changes necessary to bring the City’s housing element into compliance with Article 10.6 of the Government Code include Revised Program 2 to include outreach to the development community; Added to Program 7: Utilize available funding resources to assist 100 low- and moderate-income single-family homeowners during the 2021-2029 planning cycle; Added to Program 29: Increased staff level of administrative reviews by 10% by 2025 for new multi-family residential projects; Added review/revision of reasonable accommodations procedure to Program 33 for special needs populations; Added housing assistance to assist femaleheaded households and large households; Allow 100% residential in zones that currently allow non-residential uses: Zones that currently allow 100% non-residential uses include the R-O, MUD, and MU zones. A total of 4,423 dwelling units will be allowed in these zones; Program 13 revised to add information and provided analysis about common ownership; and Noted recent housing developments on non-vacant sites have been market rate - Updated Program 13 showing City’s efforts in encouraging affordable housing.

A Community Meeting study session review of a proposed project is not subject to the California Environmental Quality Act.

RECOMMENDATION: Receive a staff presentation pertaining proposed 2021-2029 Housing Element Update 6th Cycle receive community comments and Planning Commission Comments and file. Since this is a community meeting, no action is required and staff will forward latest update in response to HCDs May 5, 2023, comment letter

Appeal of Planning Commission Action. If you challenge in court any action of the Planning Commission related to a public hearing item, you may be limited to raising only those issues you or someone else has raised at the public hearing described in this notice, or in written correspondence delivered to the City at, or prior to, the public hearing. A decision of the Planning Commission may be appealed to the City Council. An appeal must be filed within ten (10)days following the appellant’s receipt of notice of the action.
